Brighton Gardening Services | Brighton Landscaping – Terms & Disclaimer
1. General Disclaimer
By booking a service with Brighton Gardening Services | Brighton Landscaping, you agree to the following terms and conditions. We take pride in delivering high-quality garden maintenance and minor landscaping services, but we encourage all clients to carry out their own due diligence before engaging our services.
2. Deposits & Payments
• A non-refundable deposit is required to secure all bookings. This deposit covers administrative costs and scheduling commitments.
• The remaining balance must be paid upon completion of the service unless otherwise agreed in writing.
• Failure to pay in full upon completion may result in additional charges and legal action.
3. Client Responsibilities & Due Diligence
• Clients are responsible for ensuring they have provided accurate information regarding the work required.
• It is the client’s responsibility to confirm that our services meet their specific needs before making a booking.
• Brighton Gardening Services | Brighton Landscaping shall not be liable for any misunderstandings arising from inaccurate or incomplete information provided by the client.
4. Underground Services & Waiver of Liability
• Clients must notify Brighton Gardening Services | Brighton Landscaping in writing of any known underground utilities or services, including but not limited to water pipes, gas lines, electrical cables, drainage systems, and broadband/phone lines prior to work commencing.
• If no written notification is provided, we shall assume there are no underground utilities present in the working area, and we will proceed with work at the client’s risk.
• Brighton Gardening Services | Brighton Landscaping, including its employees, subcontractors, and affiliates, shall not be held liable for any damage to underground utilities that were not explicitly disclosed in writing before work commenced.
• The client agrees to indemnify and hold harmless Brighton Gardening Services | Brighton Landscaping and its contractors from any claims, damages, repair costs, or legal liabilities arising from damage to underground services, except in cases of proven gross negligence.
• By agreeing to these terms, the client waives the right to pursue any legal action against Brighton Gardening Services | Brighton Landscaping, its employees, subcontractors, or representatives for any accidental damage or disruption caused to undisclosed underground utilities.
5. Service Limitations
• While we take every reasonable effort to deliver high-quality services, certain factors beyond our control (e.g. weather conditions, ground conditions, and pre-existing damage) may affect the outcome.
• We do not accept liability for unforeseen circumstances that may impact the work performed, including but not limited to plant health issues, pre-existing structural weaknesses, or previously undetected obstructions.
6. Cancellations & Rescheduling
• Clients must provide at least 48 hours’ notice to reschedule an appointment. Any cancellations made with less than 48 hours’ notice may result in a full charge for the scheduled work.
• Deposits remain non-refundable regardless of the reason for cancellation.
7. Liability & Indemnity
• Brighton Gardening Services | Brighton Landscaping shall not be liable for any indirect, incidental, or consequential damages resulting from our services.
• Clients agree to indemnify and hold harmless Brighton Gardening Services | Brighton Landscaping, including its employees and subcontractors, from any claims, damages, or losses arising from the work conducted, except where legally proven to be a direct result of gross negligence.
8. Property & Access
• Clients must ensure clear and safe access to the worksite before we arrive.
• Any obstructions, such as locked gates, parked vehicles, or hazardous materials, that prevent work from being carried out may result in additional charges or rescheduling at our discretion.
9. Health & Safety
• We comply with all applicable UK health and safety regulations.
• Clients must notify us of any known hazards, including but not limited to uneven ground, hidden obstacles, and hazardous plants or chemicals.
10. Complaints & Disputes
• Any concerns must be raised in writing within 48 hours of job completion.
• We will make reasonable efforts to address and resolve complaints, but no refunds will be issued once work has been completed in accordance with the agreed service.
• Any disputes shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
